Welcome to Club Tropica, please take a moment to read through these Terms & Conditions; we've tried to write them in plain English rather than legal gobbeldy gook so, everyone can understand them but, if you have any questions please feel free to email us using the Contact Us form. Suggestions from our customers are always welcomed.

The following agreement (what you are about to read), describes the terms on which Club Tropica offers you access to its service (the website, game, etc... basically everything that is Club Tropica). In order to use Club Tropica, you have to agree to follow these Terms & Conditions; when you create a new account/character for the site, we will ask you to tick a box to confirm you have read the Terms & Conditions and by ticking the box you are agreeing to abide by what is written on this page. Club Tropica may change the Terms & Conditions listed on this page at any time. If any amendments are made, you will be notified by email and asked to re-read them.

Ok, enough babbling and on with the Terms & Conditions...

THE SERVICES AND CONTENT OF CLUB TROPICA

1) USE OF CLUB TROPICA

1.1. You (the "Customer") are permitted by ClubTropica UK Ltd to access and use the Club Tropica website located at www.clubtropica.com, as long as you agree to abide by these Terms & Conditions.

1.2. To use Club Tropica, you will need to create a customer account/character, when you create this account you must provide us with accurate and complete registration information (email, date of birth, etc...) and it is your responsibility to inform us of any changes to this information. If you need to tell us about a change, please email us using the Contact Us form.

1.3 To use Club Tropica you must be at least 16 years, people under the age of 16 are prohibited from accessing the Club Tropica website. By accepting these Terms and Conditions you are confirming that you are over 16 years of age. Any user found to be younger than 16 will have their account suspended from the service until such time as they can prove they are 16 or older.

1.4. You are responsible for account security, (making sure no one else logs on your account). You should make every effort to ensure that any and all usernames/passwords associated with Club Tropica are kept safe. 1.5 You are responsible for all activity/behaviour on any/all Club Tropica user accounts you have created. You must inform Club Tropica immediately if you suspect someone knows your password, or has been accessing your account.

1.6 If you forget or lose your password/account name you must use the Contact Us form to retrieve it. If we suspect an account is being used by someone other than the person that created it, then we may place a temporary suspension, (safety ban) on that account while confirm the owners identity and return it to them.

1.7 Club Tropica users accounts are none transferable. Club Tropica customers may not willingly allow another person access to their account. Any user found to be sharing, transferring accounts will be suspended from the Club Tropica service.

1.8 Club Tropica user accounts that are unused will be deleted from the system, however, we will never delete accounts that have; furniture items stored on them, a positive/negative Isla balance (the Island currency), active VIP membership, any ban record. Accounts will be deleted without notification on a regular basis.

1.9 Club Tropica who do not use Free Isla's credited within 3 months will be removed from the system, however, we will never delete Isla's from users who have made purchases previously. Isla's will be deleted without notification on a regular basis if unused for 3 months.

1.10 The service offered by ClubTropica UK Ltd does not include the provision of computer or other equipment. To use Club Tropica you will require Internet connectivity and appropriate telecommunication links. ClubTropica UK Ltd shall not be liable for any telephone or other costs that you may incur.

1.11 Club Tropica (the website, game, etc... basically everything that is Club Tropica) is for the customers personal use only, no commercial use is permitted without prior consent from ClubTropica UK Ltd.

1.12 Club Tropica customers may not modify, copy, distribute, transmit, broadcast, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information or services obtained from Club Tropica. All our intellectual property rights and those of persons providing content to the site are fully reserved.

1.13 Club Tropica users may not seek to obtain unauthorised access to ClubTropica UK Ltd's computer systems, information or any of their databases.

1.14 The Club Tropica software is only licensed use via the Club Tropica website. Club Tropica does not permit its customers to use the Club Tropica software for any other purpose. You agree to use Club Tropica only via the Club Tropica website and not through any other means. You further agree not to create or provide any other means through which others may use Club Tropica.

1.15 You agree you will not hold Club Tropica UK Ltd, its subsidiaries, affiliates and employees, responsible for any breach to these Terms & Conditions. This would include, but is not limited to; responsibility for any reasonable legal costs made by any third party due to, or arising out of, any breach by you of these Terms & Conditions.

2) USE OF THE CLUB TROPICA CHAT SYSTEMS, INSTANT MESSAGER SYSTEM, VOICE CHAT & PROFILES

2.1 Club Tropica contains an in-game chat system, instant messaging system, user profiles and voice chat. Customers of Club Tropica may use any or all of these means to pass messages, information and images to other Club Tropica customers. Customers must agree to use these services only to post, send and receive messages and material that ClubTropica UK Ltd deems to be proper. Club Tropica users will not:

2.1.1 Break any of the Club Tropica Rules; a list of these rules can be found HERE.

2.1.2 Use the in-game chat system, instant messaging system, user profiles and voice chat, in connection with commercial surveys and contests, junk email, spamming or any other duplicative messages without prior consent from ClubTropica UK Ltd;

2.1.3 Use the in-game chat system, instant messaging system, user profiles and voice chat to insult, abuse, stalk, threaten, harass, or otherwise violate the legal rights of others (including people who are not Club Tropica customers);

2.1.4 Use the in-game chat system, instant messaging system, user profiles and voice chat to publish, link to or speak about any material that might be classed as inappropriate, this would include, but is not limited to paedophilia, bestiality, necrophilia, illegal acts, images excessively sexual in nature and adult images containing nudity that have not been marked as adult content;

2.1.5 Use the Club Tropica user profiles to upload material protected by intellectual property laws or copyright unless you own or control the rights to that material, or have received the necessary consent to do so;

2.1.6 Use the Club Tropica user profiles to upload files that contain viruses, Trojan horses, worms, or any other similar software or programs that may damage the Club Tropica site or the computer/computers of a Club Tropica customer or staff member;

2.1.7 Use the in-game chat system, instant messaging system, user profiles and voice chat to advertise, or offer to sell/buy goods/services without prior consent from ClubTropica UK Ltd;

2.1.8 Download, replicate or distribute any material posted by another Club Tropica user (this would include information passed to you via voice chat), without their knowledge and consent, unless this information is available to the public (For example, a users guestbook).

2.1.9 Use the in-game chat system, instant messaging system, user profiles and voice chat to harvest/collect personal data (a definition of personal date can be found below). This would include; email addresses, real life names, customer ages, etc...

2.1.10 Use, download or otherwise copy/provide (whether for a fee or not) any information on Club Tropica users to another party, this would include; site usage information, any directory of Club Tropica users, etc...;

2.1.11 Use the in-game chat system, instant messaging system, user profiles and voice chat to break any applicable laws or regulations;

2.1.12 Use the in-game chat system, instant messaging system, user profiles and voice chat to impersonate others or create a false identity for the purpose of misleading others;

2.1.13 Attempt to forge headers or otherwise manipulate information sent via the Club Tropica chat system, instant messaging system, user profiles and voice chat in order to disguise the source of that information;

2.2 You agree to take full responsibility for Club Tropica against all losses, liabilities, costs and expenses reasonably suffered or incurred by ClubTropica UK Ltd, all damages awarded against Club Tropica and all financial amounts paid by Club Tropica as a result of any settlement agreed by ClubTropica UK Ltd in connection with:

(a) Any claim by a third party that your use of Club Tropica is illegal, defamatory, offensive, abusive, obscene or pornographic in nature, or breaches any applicable law, regulation or code of practice;

(b) Any claim by any third party that your use of Club Tropica infringes copyright or other intellectual property rights;

(c) Any fines/penalties imposed on ClubTropica UK Ltd by any regulatory, advertising or trading body or any other authority in connection with your use of Club Tropica;

2.3 ClubTropica UK Ltd has no obligation to monitor content posted using the in-game chat system, instant messaging system, user profiles or voice chat. However, ClubTropica UK Ltd reserves the right to review, record and store any and all information, (this includes voice chat) posted by Club Tropica customers and remove or edit any information deemed unsuitable.

2.4 ClubTropica UK Ltd reserves the right to terminate your access to Club Tropica and all its systems at any time, without notice, or for any or no reason.

2.5 Club Tropica Moderators shall treat all customers the same, regardless of sex, age, marital status, colour, race, ethnic, or national origin.

2.6 ClubTropica UK Ltd reserves the right to disclose/publish any information it deems necessary to satisfy any applicable; law, regulation, legal process or governmental request.

2.7 ClubTropica UK Ltd reserves the right to edit, refuse to post, or to remove any information or material, in whole or in part, that it deems unsuitable.

2.8 ClubTropica UK Ltd does not control or endorse the content, messages or information found on the in-game chat system, instant messaging system, user profiles or voice chat and therefore, does not accept liability or responsibility for any actions resulting from said content, messages and information.

3) EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY

3.1 The Club Tropica website contains information that ClubTropica UK Ltd believes to have come from reliable sources. However, ClubTropica UK Ltd accepts no responsibility for this information, nor does it guarantee the accuracy of any information published on the Club Tropica website.

3.2 ClubTropica UK Ltd gives no guarantee that the content of the Club Tropica site, the software used to support it and the other services offered by ClubTropica UK Ltd are free from error. ClubTropica UK Ltd accepts no responsibility or liability for interruptions to the service it provides, infection by viruses or anything else that has contaminating or destructive properties.

3.3 ClubTropica UK Ltd will not be liable for any damages incurred (this would include, but is not limited too; loss of business opportunities, data, goodwill, projects, or profit loss) howsoever arising (in contract or otherwise) by you, from the use of, or inability to use, the Club Tropica website, or any of its content/material. Further, ClubTropica UK Ltd will not be liable for any action taken against you as a result of you using the Club Tropica website or any of its content.

3.4 You agree that in any event ClubTropica UK Ltds liability for any damages and losses (including negligence) shall not under any circumstances exceed the amount paid by you (if any), for accessing the Club Tropica website.

4) THIRD PARTIES

4.1 You agree to acknowledge that any links that appear on the Club Tropica website, may lead to information, material and images located on servers/sites maintained by independent third parties, over whom ClubTropica UK Ltd has no control. ClubTropica UK Ltd accepts no responsibility or liability for any of the information, material or images contained on those servers/sites; nor does ClubTropica UK Ltd accept responsibility for the availability of such external sites or resources.

4.2 You acknowledge and agree that you are solely responsible for evaluating any goods or services offered by us, or by third parties via the Club Tropica website and that Club Tropica will not be held in any way responsible for any transactions between you and third parties.

4.3 You acknowledge that links to other websites may send "cookies" or other downloads to your PC and solicit personal information. ClubTropica UK Ltd has no control over these external sites and accepts no responsibility for their actions.

4.4 ClubTropica UK Ltd accepts no responsibility or liability for adverting material submitted to ClubTropica UK Ltd and displayed on the Club Tropica website. The advertisers are responsible for ensuring that any and all material submitted for inclusion on the Club Tropica website complies with all legal requirements.

5) GENERAL PRACTICES REGARDING USE AND STORAGE

You acknowledge and agree ClubTropica UK Ltd may establish general practices and limits concerning use of the website and their service, this includes but is not limited to; the maximum number of days that messages or any other uploaded content will be stored on the website servers, the maximum number of messages that may be sent/received by a customers account, the maximum size of any message that may be sent/received by a customers account, the maximum disk space that will be allocated to each Club Tropica user on the servers.

6) CLUB TROPICA SOFTWARE LICENCE

6.1 ClubTropica UK Ltd may occasionally provide you with certain software which you can download from the Club Tropica website to enhance your experience of the Club Tropica site. You acknowledge and agree that any material downloaded or otherwise obtained through the Club Tropica website is downloaded at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of any such software.

6.2 Any software downloaded from the Club Tropica website is protected by applicable intellectual property, copyright, and other laws and may only be used subject to the terms of the user licence agreement which will accompany the software.

6.3 You acknowledge and agree that the copying, reproduction, modification, and creation of plagiaristic works from any software obtained through the Club Tropica site is prohibited. Further, you agree not to redistribute, sell, loan, lease, or rent any software acquired through the Club Tropica website, unless it is expressly permitted under the terms of the softwear licensing agreement.

6.4 You acknowledge and agree that ClubTropica UK Ltd gives no warranty in relation to any software downloaded via the Club Tropica site. You may rely only on such warrants provided by the software proprietor in the licensing agreement.

7) CLUB TROPICA SERVICES SUBJECT CHARGES

7.1 You acknowledge and agree that certain services are provided by ClubTropica UK Ltd for or a fee or other charge. These fees and charges are described on the Club Tropica websites, you agree to the pricing, payment and billing policies applicable to which can be found on the 'Isla' page.

7.2 Use of the ClubTropica UK Ltd service includes the provision of several enhanced services which are subject to an additional charge, these would include, but are not limited to; VIP Club membership, additional photo storage for profiles, virtual furniture to furnish your villa and SMS messages to other Club Tropica users mobile phones.

7.3 You acknowledge and agree that any items purchased from the Club Tropica furniture catalogue will be held on the ClubTropica UK Ltd servers and may be accessed by you subject to these Terms & Conditions. No items purchased can be removed from the ClubTropica UK Ltd servers or downloaded to your PC.

7.4 ClubTropica UK Ltd reserves the right to withdraw enhanced service or make any changes to these services that it deems necessary. In the event of such a change all registered Club Tropica customers will be notified of the change via email.

7.5 You acknowledge and agree that by signing up for auto renew on any or all of the enhanced service you are granting ClubTropica UK Ltd the right to automatically charge your account for these services when they expire. The charge for these services will be deducted from your Isla balance, if there are not sufficient Isla on your account then the services will be charged to the payment method stored for use on your Club Tropica customer account. If no payment method is stored on your account then provision of the service will be terminated.

7.6 ClubTropica UK Ltd reserves to the right to; change, remove or add payment methods for enhanced services. The offer of any/all payment methods is at the sole discretion of ClubTropica UK Ltd.

7.7 ClubTropica UK Ltd from time to time may offer its users free virtual credits or Isla, which can be used as payment towards these enhanced services. The Isla will be deducted from your account as and when purchases are made.

7.8 From time to time Club Tropica may offer, its customers, the right to purchase physical goods via the Club Tropica site. Where goods are sold directly through ClubTropica UK Ltd, you have the right to return these for a full refund (minus delivery charges) provided; the goods are returned at your own expense, within fourteen days of receipt and in the condition they were sold. Goods sold via third parties, the third parties Terms & Conditions will apply and Club Tropica assumes no liability for refunds on purchased items.

7.9 You acknowledge and agree that once a purchase is made, this includes, but is not limited to virtual furniture; you have no rights to cancel the purchase/contract other than pursuant via these Terms and Conditions.

7.10 Club Tropica customers can if they desire terminate their account, refunds will only be provided to the customer when the total of unused credits amounts to more than £10 in real money. Further to this, Club Tropica will deduct a £5 service fee for account termination. Refunds will not be provided if an account is suspended, or terminated in any way by ClubTropica UK Ltd.

7.11 Club Tropica reserves the right to add new services for additional fees and charges, or amend fees and charges for existing services, at any time at its sole discretion.

8) DATA PROTECTION

8.1 Any and all information provided to Club Tropica about you will only be used in accordance with the Club Tropica Privacy Policy. Club Tropica adheres to the Date Protection Act.

8.2 Club Tropica record and reserve the right to monitor all communication within the Club Tropica site. Club Tropica will never release this information without the customers consent.

8.3 The term "Personal Data" shall mean (except where the context requires otherwise) any data supplied by a Club Tropica customer, which relates to a living individual who can be identified from that data, or from these data and other information which is in the possession of or is likely to come into the possession of ClubTropica UK Ltd.

8.4 These Terms & Conditions should be read in accordance with the Club Tropica Privacy Policy.

9) CLUB TROPICA COMPETITIONS AND PRIZE DRAWS

You acknowledge and agree that any competitions run via the Club Tropica website will be subject to additional Terms and Conditions, these will be made available at the time of such competitions.

10) CHOICE OF LAW AND JURISDICTION

10.1 These Terms and Conditions are governed by the laws of England and Wales. ClubTropica UK Ltd and you shall agree that the English Courts have exclusive authority to determine any matter or dispute in connection with, or arising from the Club Tropica website and these Terms & Conditions.

10.2 Club Tropicas failure to enforce these Terms and Conditions does not constitute a waiver of such rights.

10.3 If any part of these Terms and Conditions is found to be invalid by a court of law or any other appropriate body, the remains of the Terms and Conditions will remain in full force and effect.

10.4 The sub headings used in these Terms and Conditions are for convenience only and they have no legal or contractual effect.
